Agreement between the Travel Agency, hereinafter, “Summitour”, “agency”, “we”, and “us” or “our” refer to Summitour Travel Agency Inc. and Summitour S.R.L. and the client, hereinafter “you”. Summitour Travel Agency Inc. and Summitour S.R.L., gives you a warm welcome to the web sites www.summitour.com

Please read carefully:

These websites are designed to provide customers with the necessary tools so that they can gather travel information, or tourism products, as well as to determine availability and make reservations. This website is offered to you conditional upon your acceptance without modification of all terms, conditions and notices set forth below (the “Agreement”). Once you access our website or make a reservation through our website, helpline or via e-mail, you agree to be bound by this agreement. Please read the agreement carefully and if you do not agree with all of these terms and conditions contained herein, please do not use our website or call center to make reservations. Summitour reserves the right to make any amendments necessary to this agreement at the time we choose and without prior notice. The mere facts that you continue accessing our website or to make reservations means you have accepted the updated version of this agreement.

​First: Using the Website

​ You must ensure to use the website under the following conditions:​

  1. That you are at least 18 years old.​
  2. That you have the capacity to meet your obligations.​

To use our website in accordance with the clauses described in this agreement.​

  1. That you will only use the website to make reservations for you or on behalf of another person for whom you are legally authorized to act. In that event, you must inform that person of the terms and conditions including any rules or restrictions applicable and all the information supplied by you on this website is true, accurate, current and complete.​
  2. If you register with Summitour, you will be responsible for safeguarding the account information registration and will be responsible for the use of it by you and anyone other than you.

Second: Prohibited Activities

​Al services or products posted on this website are the property of Summitour or our providers and suppliers. Any reproduction, distribution, copying, publication, modification, transfer or sell of any information, products, services or software used on the website without proper authorization from Summitour, our providers and suppliers, it is strictly prohibited.​

  1. Use this website for purposes to injure Summitour or any of its debtors which may cause some prejudice or impediment to the normal functioning of the website.​
  2. Access, monitor or copy this website using a spider, robot, scrapers or any other tool or program for any purpose without our written permission or consent.​
  3. Making false claims, speculative or fraudulent or contracts.​
  4. Include our website information in search tools for the purpose of price comparisons.​
  5. Creating a mirror website or incorporate any part of the website anywhere else without our written permission.​
  6. Summitour reserves the right to deny the access to our website in the time we choose, at our sole discretion, without notice and without compensation to all users who do not comply with the terms and clauses contained in this agreement.​

Third: Summitour responsibilities

​Any seats reservation, tickets to all types of transportation, hotel rooms booking, tours or any other product or service offered through our website, unless otherwise noted, is undertaken by Summitour as a mediator. Summitour facilitates the contact between the service provider and the potential customer. Therefore, Summitour, acts as an intermediary between the user and the service provider or organizer. Summitour is not responsible for errors or omissions or for any breach or inaccuracy and diligent performance of the services that are part of the contract between the service provider and the client. Given that is the client is who hires the products and services directly with the supplier or provider, any complaint or inquiry made regarding the service should be directed to the supplier or borrower. At all times, Summitour is willing to assist the client in doubt, dissatisfied or with any suggestion that may have. Summitour, can apply constant changes and improvements on their website and under no circumstances will the Agency be liable for any direct or indirect damages related to or arising from use of our website, or for any delay or delays produced or inability to use it.

​Fourth: Suppliers rules and restrictions

​Purchases of goods and services and reservations are subject to additional terms and conditions. By using our website you agree to abide by the terms and conditions of purchase imposed by any supplier or service providers with whom you can choose to perform a particular operation, including, but not limited to, payment of any debt due and compliance with the rules and restrictions laid down by suppliers pursuant to the use and availability of prices of products and / or services. At the time of check-in, some hotels will request a credit card or cash deposit to cover additional expenses. This deposit is separate from any payment Summitour may have received from your reservation. Any violation of the rules or restrictions described above may result in cancelling your reservation. In addition you will be denied access to our tourism products and services and you will lose any amount deposited for this reservation and Summitour, will be entitled to withdraw or debit from your account any expenses incurred resulting from noncompliance.​

-Airline Prohibited Practices​

You agree not to purchase a ticket or tickets containing flight segments that you will not be using, such as a “point-beyond”, “hidden-city”, or “back-to-back tickets” if those practices are prohibited by the airline(s). You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel if that practice is prohibited by the airline(s). You acknowledge that most airlines prohibit all such tickets, and therefore we do not guarantee that the airline will honor your ticket or tickets if you engage in these practices. You agree to indemnify the Covered Parties against airline claims, on the basis of these or any other prohibited practices, for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.​

-Use of Flight Segments​

Most airlines require you to use flight coupons in sequential order. For those airlines who allow the use of a ticket for only one segment, if you do not cancel all or part of your journey prior to the departure of any segment of your itinerary, you may forfeit up to the value of your airline ticket, depending on the rules of the fare purchased.​

-Taxes and Fees Charges on Published Price Airline Tickets​

Government imposed taxes and fees and any applicable airline imposed fees are either included in your fare or itemized separately on your checkout page to provide a trip cost. Tax rates in effect at time of purchase are applied to your ticket price. Retroactive tax rate increases may be the responsibility of the traveler. For international flights, as described below, Entry or Exit Fees may be charged that are not included in your fare or itemized separately on your checkout page. A non-refundable fee per ticket will be applied to published price airline itineraries that include more than one carrier. Paper ticket fees, itinerary change/cancellation/refund fees, baggage fees and Entry or Exit fees on certain international flights may also apply to your itinerary, as described below;​

Paper Ticket Fees: A shipping and handling fee will be charged if your itinerary requires the issuance of paper tickets. If your tickets are rerouted or are undeliverable and are returned, there will be an additional re-handling fee. Note: This fee, if applicable, will be displayed on your contract prior to purchase.​

Itinerary Changes/Cancellations/Refunds: Air travel itinerary changes, if permitted by the airline fare rules, may have a change fee charged by the airline typically ranging between $200 and $300 USD per ticket that will vary by market, carrier and specific fare rule. In addition, any changes made with Summitour to your itinerary will incur per ticket Summitour processing fee.

Baggage and Other Ancillary Airline Fees: The airlines may require you to pay additional fees at the airport for certain services and/ or if you exceed certain limits as dictated by the airline, such as the number of bags or weight allowed, and some airlines do not offer a free baggage allowance. During the booking process, Summitour provides a summary of key terms of an airlines baggage fees, but each airline should be consulted for complete information about its baggage and other ancillary fees.​

Entry/Exit Fees: If you are traveling internationally, some countries or airports charge fees upon entering and/or exiting the country. These fees are not included in the ticket price, or the taxes and fees we display on our website prior to purchase. For more information on a specific country’s entry/exit fee, we suggest that you visit  prior to departure.

Hotel Service Restrictions​

-Check In: Upon check-in, the reservation holder must present a valid ID and credit card or, in the hotel’s discretion, debit card, in his or her name (the amount of available credit required will vary by hotel). Debit cards may not be accepted.​

-Double Occupancy: All hotel reservations are guaranteed for double occupancy (i.e. 2 adults) and accommodations for more than two adults are not guaranteed. Some hotels may not allow extra guests. If your hotel does allow extra guests, there may be additional charges. These charges vary and will be payable directly to the hotel.​

-Late Arrival and Failure to Check-in on First Night: While you should call Summitour if you wish to cancel a cancellable reservation in advance of your stay, if you are going to be delayed on your date of check in or find that you cannot check in to your hotel on the date you requested, you should contact the hotel to let them know. If you fail to check in to your hotel on the day of your reservation and do not alert the hotel, the remaining portion of your reservation may be canceled and you may not be entitled to a refund, depending on the terms and conditions of the applicable hotel.​

-Disability Needs: If you have disability needs (for example only, you need a wheelchair accessible room or require the use of a service animal) you must call the hotel and verify that disability needs can be met. If your disability needs cannot be accommodated by the hotel, please call Summitour customer service.​

-Hotel Accommodations and Special Requests: Depending upon which Summitour.com hotel reservation service you use, you may or may not be able to select your room type and number and type of beds. Room assignments are based on hotel availability and are at the hotel’s discretion. We cannot guarantee a non-smoking room. If you have special requests (including, for example, preferences for smoking or nonsmoking rooms, a specific room, particular bedding, floor location, closeness to an elevator, connecting rooms, or pet accommodations), you must call the hotel and verify that special requests can be met after you have made your booking. Since Summitour.com has no control over which room a hotel will assign to you, Summitour.com cannot accommodate special requests in advance of your booking and cannot guarantee that special requests will be met.​

-Must be 21 Years of Age: The guest on the reservation must be 21 years or older to check into the hotel.​

-Frequent Traveler Points: Frequent traveler points, upgrades, certificate vouchers and other discounts or incentives may not apply to summitour.com’s hotel services.​

-Hotel Star Ratings (General): Summitour.com’s star rating system is provided for your reference. Like other well-known hotel rating systems, summitour.com considers a number of factors in evaluating the quality of participating hotels such as: amenities, facilities, reputation, brand, other rating services, customer feedback from guests who have stayed at the hotel, etc., to assign a single star rating. Summitour.com screens participating hotels carefully and updates our information periodically to ensure the validity of our ratings. Our ratings systems may sometimes differ from those of other rating systems that you may be familiar with. We do not warrant or guarantee that our star rating system is equal to or consistent with any other star rating system and reserve the right to change a hotel’s rating at any time with or without notice.​

-Accommodation Types: Summitour offers its customers various properties, including hotels, motels, bed and breakfasts, resorts and other types of rentable accommodations.​

-Prices: Sometimes cheaper rates are available for a specific stay at a hotel, however, these rates made by hotels may carry special restrictions and conditions, for example in respect of cancellation and refund. Please check the room and rate details thoroughly for any such conditions prior to making your reservation.​

-Pricing Errors: We endeavor to publish and maintain accurate prices and information for the services we offer. Hotels provide us with the price and other information related to these services. In the event, however, that a service is listed or provided to us at an incorrect price or with incorrect information due to typographical error or other error in pricing or service information received from a hotel, we retain the right to refuse or cancel any Requests placed for such service. We shall have the right to refuse or cancel any such Requests whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your Request is canceled because of incorrect hotel information, we will promptly issue a credit to your credit card account in the amount of the charge. Prices, rates and inventory are subject to availability from the hotel.​

-Hazardous Materials: Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years? Imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples include paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. Fifth:  National, International Destinations and Force Majeure​

Summitour, in any way guarantee, represent or claims that a trip to a national or international destination does not contain any risk, or be advisable or not. Summitour, is not responsible for any damages that may arise from travel to these destinations. You should be aware that each target can be subject to problems of insecurity, sociopolitical changes, events, weather or force majeure (such as natural disasters, strikes, wars, terrorist attacks, riots, revolts, epidemics, etc.). The Agency, recommends that before you travel to a national or international destination, gather the necessary information about the particular destination or destinations involved in your journey.​

Passport and Visa: You must consult the relevant Embassy or Consulate for this information. Requirements may change and you should check for up-to-date information before booking and departure. We accept no liability if you are refused entry onto a flight or into any country due to your failure to carry the correct and adequate passport, visa, or other travel documents required by any airline, authority, or country, including countries you may just be transiting through. This includes all stops made by the aircraft, even if you do not leave the aircraft or airport.​

Health: Recommended inoculations for travel may change and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip.​

Disinsection: Although not common, most countries reserve the right to disinsect aircraft if there is a perceived threat to public health, agriculture or environment. The World Health Organization and the International Civil Aviation Organization have approved the following disinsection procedures: (1) spray the aircraft cabin with an aerosolized insecticide while passengers are on board or (2) treat the aircraft’s interior surfaces with a residual insecticide while passengers are not on board.

BY OFFERING RESERVATIONS FOR TRAVEL PRODUCTS IN PARTICULAR INTERNATIONAL DESTINATIONS, SUMMITOUR DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH AREAS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.​

Sixth: Cancellations

​BEFORE MAKING AN ONLINE PAYMENT, BY TELEPHONE OR ON-SITE FOR OUR SERVICES, PLEASE READ CAREFULLY OUR CANCELLATION POLICIES AND OUR TERMS AND CONDITIONS BELOW. BY MAKING A PAYMENT FOR YOUR SERVICES YOU ACKNOWLEDGE THAT YOU AGREE TO OUR CANCELLATION POLICIES AND OUR TERMS AND CONDITIONS.​

VACATION PACKAGES:​

Deposit and Final Payment

-A non-refundable land deposit of $100 per passenger is required at the time of request. Deposit will be applied to final invoice.

-From 91 to 120 days or more before the day of departure, we return 75% of the amount paid after deposit.

-From 61 to 90 days before the day of departure, we return 50% of the amount paid after deposit.

-From 31 to 60 days before the day of departure, we return 25% of the amount paid after deposit.

-From 1 to 30 days or more before the day of departure, non-refund applies.​

You must be at the airline’s counter 90 minutes before departure. Do not forget to bring your valid passport and the corresponding visas in case you need them from all passengers, including children in your party.​

ESCORTED TOUR PROGRAM POLICIES:​

Deposit and Final Payment

-A non-refundable land deposit of $250 per passenger is required at the time of request. Deposit will be applied to final invoice.

50% of payment is due 60 days prior to scheduled departure.​

-Full payment is due 30 days prior to scheduled departure, unless otherwise noted.​

Land Revision Fees

A fee of $50.00 per transaction will be charged for any alteration or revision made to a confirmed itinerary. A fee of $100 per person will be charged for any name change.​

Name change will not be allowed within 14 days of departure and regular cancellation fees will apply.​

Tour Program Cancellation Policies:​

If you cancel your reservation, you have the right to receive a refund as set forth below. You must send all requests for refunds to us in writing by facsimile or by email. Refunds will be made within 14 days of receipt of your notice of cancellation.​

Summitour Travel Agency Inc. reserves the right, in its sole discretion, to reject an individual at any time prior to departure, or to cancel the ESCORTED TOUR PROGRAM in which a PARTICIPANT is scheduled to participate. In the unlikely event of a cancellation by Summitour, or if a PARTICIPANT has been rejected, the total amount paid to Summitour (less airfare) will be refunded, unless the cancellation is due to non-payment of the ESCORTED TOUR PROGRAM fee and/or Flight Package by the ESCORTED TOUR PROGRAM fee’s due date or is due to governmental action beyond our control, in which case the amount refunded will be reduced to the extent Summitour has incurred expenses in organizing the PROGRAM. Other than such a refund, Summitour will not be responsible to a PARTICIPANT for any other refund, costs, interest, liability, or damages of any kind.

If PARTICIPANT cancels for any reason, he or she must notify us in writing. The cancellation will be effective upon we receive the written notification at our office in Miramar, FL. Summitour incurs in substantial administrative and planning costs prior to the departure of PARTICIPANT therefore regrettably, if PARTICIPANT cancels his or her participation in the PROGRAM, funds paid by PARTICIPANT to Summitour can be refunded only as set forth below.​

The $250 deposit is non-refundable. PARTICIPANT may apply this deposit to another ESCORTED TOUR PROGRAM to be scheduled to depart within 365 days of the original scheduled start date, subject to space availability.

If the cancellation is effective:​

-61 days or more prior to the scheduled start date, the funds paid towards the program, not including the deposit and any applicable airline cancellation penalties, will be refunded.

-60 to 45 days prior to the scheduled start date, 50% of the funds paid towards the program, will be retained, and the balance, not including the deposit and any applicable airline cancellation penalties, will be refunded.

-44 to 31 days prior to the scheduled start date, 75% of the funds paid towards the program will be retained, and the balance, not including the deposit and any applicable airline cancellation penalties, will be refunded.

-30 or fewer days prior to the scheduled start date, none of the funds will be refunded.​

If PARTICIPANT cancels his/her program and chooses a refund, PARTICIPANT will forfeit the future use of his/her deposit.

No refunds will be made for unused portions of the PROGRAM for any reason. Flight package costs are non-transferable.

PARTICIPANT is responsible for transportation costs to the start location in Miami or other designated gateway city. The PARTICIPANT is also solely responsible for any airfare or other travel fees, charges, expenses or penalties that might result from any cancellation of or change in the PARTICIPANT’s PROGRAM, whether the PARTICIPANT cancels the PROGRAM or it is cancelled or altered by Summitour.​

It is important that a PARTICIPANT understands the cancellation policy. If it is not clear, the PARTICIPANT should ask for clarification. Summitour cannot make exceptions to this cancellation policy for any reason, including medical emergencies. SUMMITOUR STRONGLY URGES THE PARTICIPANT TO PURCHASE ADDITIONAL TRIP CANCELLATION INSURANCE. Contact Summitour Travel Agency Inc. directly for more information. (ACCAM #: F207037)​

You may modify or cancel your reservation at any time you understand it is convenient. Summitour does not charge cancellation fees, however, the hotel may charge cancellation fees depending on the date you choose to cancel or change your booking. In addition, you understand that the cancellation policy of each of the establishments or hotels is inherent in each facility and that it varies from one hotel to another, so you should review the hotel cancellation fees that are reflected in the booking before making a payment.​

These policies are also present in the bonus you get for your reservation, if applicable. The amount or penalty applied by a hotel may vary depending on the date you cancel your reservation, and can range from a small charge to the total balance of your reservation, a sum equivalent to one night stay at the hotel facility where you have made the booking or the full amount of your reservation, depending on the time you decide to cancel and each particular provider. You agree to pay any cancellation fee or change you incurred. There are exceptional cases when hotels do not allow cancellations or changes to their bookings once the reservation is done. You agree to abide by the terms and conditions imposed with respect to your prepaid hotel reservations. Regarding other services such as Car Rental, Activities, Vacation Packages and Tours, the cancellation policy will be clearly stated before completing the booking and will also be reflected in the bonus you obtain from your reservation.​

ACCOMMODATION POLICIES:​

The bookings must be paid completely once confirmed to the customer.

If the reservation is not paid in full within 24 hours after your confirmation it will be canceled automatically.

A fee of $50.00 per transaction will be charged for any alteration or revision made to a confirmed your reservation. A fee of $80 per person will be charged for any name change. Name change will not be allowed within 7 days of departure and regular cancellation fees will apply.​

Private Houses Cancellation Policies

Cancellation policy in private homes, private hostels, or hotels (Does not apply to accommodation reservations as part of a vacation package) are as follows:​

-Free cancellation for private houses and private hostels up to 7 days before the check in date.

-For cancellations in private homes and private hostels from 6 days to 3 days from the date of check in, a charge for the cost of one night will be applied.

-For cancellations in private homes and private hostels from 2 days to 1 day before the date of check in, a 50% charge will apply.

-In case of Non show for reservations made in private houses and private hostels a charge of 100% of the amount of the reservation will be made.​

Hotel Cancellation Policies

-Free Cancellation for hotel reservations with 15 days or more from the date of check in.

-For cancellations at the hotels 15 days to 7 days from the date of check in, a charge for the cost of one night will be applied.

-For cancellations at the hotels from 6 days to 1 day before the check-in date, a 30% charge will be applied to the reservation.

-In case of non-show for reservations made at the hotels a charge of 100% of the amount of the reservation will be made.​

The above policies do not apply to non-refundable hotel rates. These rates are subject to regular price discounts at the time of booking and are specified in your hotel voucher. In this type of rates, you incur 100% of expenses if you cancel. We suggest that when you book with this type of rate you get a travel insurance.​

Summitour is not responsible for reservations made through Booking.com, or for reservations made through third party websites. By booking through the Booking.com system, you agree to that provider’s terms of use and cancellation policies.​

DOMINICAN REPUBLIC EXCURSION AND TOURS:​

CANCELLATION BY THE CLIENT

-Cancellation notified 72 hours or before the pick-up time described in your voucher for the activity: Full refund. The initial deposit done to Summitour Travel Agency is nonrefundable.

-Cancellation notified between 72 and 24 hours before the pick-up time described in your voucher for the activity: 50% refund of the total amount of the reservation. The initial deposit done to Summitour Travel Agency is nonrefundable.

-Cancellation 24 hours or less than the pick-up time described in your voucher for the activity: No refund.

-No show: No refund.​

Weather-related cancellations: Refund of the reservation amount is not the first option to apply. Please review our climate-related policy below.​

CLIMATE-RELATED POLICIES

Sometimes the weather does not cooperate with our activities. Please note that all our excursions are conducted outdoors. However, Destiny Caribbean Tours may cancel excursions for security reasons due to weather inclement. In these cases, we will do everything in our power to accommodate our clients another day on the same excursion or to accommodate them on an alternative excursion of equal or greater price.

​If there is no alternative to re-location, a refund will be done, and it will be completed by the same method in which the payment was done by the client. Destiny Caribbean Tours will not pay the applied charges by third parties such as PayPal, Cards, Cash on Delivery, Bank Wire Transfers, Mobile Payments, Online Bank Transfers, etc.​

Booking conditions.

Once the excursion provided by Destiny Caribbean Tours has been purchased, these conditions are permanent and mandatory.

All excursions are subject to change without prior notice.​

Descriptions, departure times, itineraries, and location may be altered and may vary due to unforeseen circumstances.

Excursion descriptions, schedules, and hours of operations are based on estimated times.​

Some changes are unavoidable due to reasons beyond our control and can be made at the sole discretion of Destiny Caribbean Tours, the receptive to this program.​

FLIGHT TICKETS​

Each airline has its own cancellation policies. In case you need to cancel your flight ticket, you should contact the airline directly with your locator number and personal information.​

Summitour is only responsible TO PROCESS THE REQUEST for cancellations of flight tickets included in a vacation package, or under a group contract managed by Summitour. Summitour does not guarantee the full refund for flight tickets since each airline has their own cancellation policies.

​CANCELLATION DUE TO *EXTRAORDINARY CONTINGENCIES, EVENTS OF FORCE MAJEURE OR FOTUITOUS CASE:​

If we are in the presence of an extraordinary contingency or events of force majeure, and you need to cancel your trip even when service providers have not canceled their services, you must understand that each borrower has its own political policies for these cases. Some tourist or travel service providers agree to return the amount of your reservation at no cost, others will apply a management fee and others will offer you a credit for your reservation for a specified time. Summitour acts as an intermediary between the client and the final service provider to assert their rights, but it is NOT responsible for the final decision of the tourist or transport service providers.​

Some of the events described above are not covered in your travel insurance policies. Please contact your insurer for details of your coverage.​

*Extraordinary contingencies, events of force majeure or fortuitous case: Hurricanes, earthquakes, and other major meteorological events, pandemics, war conflicts, or last-minute political changes or acts of authority by public officials.​

Seventh: Liability Disclaimer​

The software, products, services and information published in this website may contain errors or inaccuracies, including pricing errors. Summitour, does not guarantee the accuracy of all information and assumes no responsibility for any errors or inaccuracies that may arise from the information in any of the products or services offered on the site. Usually, such information is provided to Summitour by suppliers or service providers. Categorizations or hotel ratings published on our website are solely for the purpose of serving as a general reference. Summitour, does not guarantee the accuracy of hotels ratings. The Agency or any of its respective suppliers may make changes or improvements to the site at the time of their choice. Summitour S.R.L, is a subsidiary of Summitour Travel Agency Inc, in the Dominican Republic. Any dispute or breach of this contract will be made available to the competent courts of Broward County, FL.​
